Northern Frights Shop – Terms & Conditions

These Terms & Conditions apply to purchases made through the Northern Frights online shop, including merchandise, event tickets, event add-ons, sponsorship, advertising and other products or services.

By placing an order with Northern Frights Ltd, you agree to these Terms & Conditions.

Nothing in these terms affects any statutory rights which cannot legally be excluded.

Throughout these terms, “Northern Frights”, “we”, “us” and “our” refer to Northern Frights Ltd.


2. Placing an Order

When you place an order through our website, you are making an offer to purchase the products or services shown in your order.

Your order is accepted when we send confirmation that it has been accepted or processed.

We reserve the right to refuse or cancel an order where reasonably necessary, including where:

  • A product or service is unavailable;

  • There has been an obvious pricing or website error;

  • Payment has not been successfully received;

  • We suspect fraudulent or unauthorised activity;

  • Incorrect information has been provided; or

  • We are otherwise unable to fulfil the order.

If we cancel an order after payment has been taken, we will refund the amount paid for the cancelled product or service, subject to any circumstances where the cancellation has arisen from a breach of these terms by the purchaser.


3. Prices, VAT & Payment

All prices are shown in Pounds Sterling (GBP).

Where VAT applies, prices will be displayed in accordance with applicable UK requirements.

Any applicable delivery charges or other fees will be displayed before you complete your purchase.

Payment must be made using one of the payment methods available at checkout.

We reserve the right to change our prices at any time. Price changes will not affect orders that have already been accepted.

If an obvious pricing error occurs on the website, we are not required to supply a product or service at the incorrect price. Where this happens after an order has been placed, we will contact you and either offer the product or service at the correct price or cancel and refund the affected purchase.


4. Physical Products & Merchandise

We sell physical merchandise including clothing, mugs, bags, accessories and other Northern Frights and horror-themed products.

We make reasonable efforts to ensure that product photographs, colours, descriptions and dimensions are accurate.

However:

  • Colours may vary slightly depending on your device or screen;

  • Minor variations may occur during printing or manufacturing;

  • Product images may be for illustrative purposes; and

  • Measurements and dimensions should be considered approximate unless expressly stated otherwise.

Customers are responsible for checking clothing sizes and product information before placing an order.


5. Delivery

Available delivery methods and charges will be displayed during checkout.

Any dispatch or delivery dates provided are estimates unless we expressly state that a date is guaranteed.

We are not responsible for delays caused by circumstances outside our reasonable control. Where there is a significant delay, we will contact you where appropriate.

You are responsible for providing a complete and accurate delivery address.

If an order is returned to us because the customer supplied an incorrect or incomplete address, we may require payment of additional postage costs before resending it.

Risk in physical goods passes to you when the goods are delivered to you or to a person identified by you to receive them.


6. Consumer Cancellation Rights

For most physical products purchased online by consumers, you have the right to change your mind and cancel your order within 14 days of receiving the goods, subject to certain legal exceptions.

You must notify us within the 14-day cancellation period.

After notifying us that you wish to cancel, you will normally have a further 14 days to return the goods.

Unless the goods are faulty, incorrect or not as described, you are responsible for the cost of returning them.

You may inspect products in the same way that you reasonably could in a shop. If products have been handled beyond what is reasonably necessary to establish their nature, characteristics and functioning, we may make an appropriate deduction from the refund to reflect any reduction in value.

Certain products and services are excluded from statutory cancellation rights. These are explained below.


7. Returns & Refunds

Please include your order number and details of the product you wish to return.

Unless the product is faulty, incorrect or not as described, you are responsible for the cost of returning it.

Where you validly exercise a statutory right to cancel an online purchase, eligible refunds will include the price paid and the standard outbound delivery charge where required by law.

If you chose a more expensive delivery option than our standard delivery service, we are not required to refund the additional delivery cost.

Refunds will normally be made to the original payment method and within the timescales required by applicable law.


8. Faulty, Damaged or Incorrect Products

Your statutory rights are not affected by these terms.

Goods supplied by Northern Frights must meet the standards required by applicable UK consumer law, including being as described, of satisfactory quality and fit for purpose where applicable.

Please include your order number and details of the issue. We may also ask for photographs where these would reasonably help us assess the problem.

Depending on the circumstances and your statutory rights, we may offer a repair, replacement, price reduction or refund.


9. Products That Cannot Normally Be Returned

The statutory right to cancel does not apply to certain products and services.

Depending on the circumstances, this may include:

  • Products made to your specifications or clearly personalised;

  • Sealed goods that are not suitable for return for health protection or hygiene reasons once unsealed;

  • Digital content where supply has begun after you expressly agreed to immediate supply and acknowledged the loss of your cancellation right, where applicable; and

  • Other products and services excluded under applicable consumer legislation.

This does not remove your statutory rights where a product is faulty, damaged, not as described or otherwise does not comply with the law.


10. Event Tickets

Event tickets purchased through the Northern Frights Shop are subject to these terms and any additional terms specifically stated for the relevant event.

Non-Refundable Tickets

Event tickets are non-refundable unless the event is cancelled by Northern Frights Ltd, subject to any statutory rights that apply.

Please ensure you are able to attend and have selected the correct event, date and ticket type before completing your purchase.

Being unable to attend because of personal circumstances does not normally entitle you to a refund.

Transfers

Tickets may not be transferred where the relevant event or ticket type specifically prohibits transfer.

Where transfers are permitted, Northern Frights Ltd may require prior notification or written approval.

Tickets must not be resold for commercial purposes without our permission.

Age Restrictions

Some Northern Frights events, experiences or areas may have age restrictions.

You are responsible for checking all age restrictions before purchasing.

We may request appropriate proof of age.

A refund will not normally be provided where entry is refused because an attendee does not meet a clearly advertised age requirement.

Entry

Every attendee must hold a valid ticket for the relevant event.

Tickets may be digital or printed depending on the event.

We reserve the right to refuse entry where a ticket is invalid, duplicated, fraudulently obtained or has already been used.


11. Event Changes

Northern Frights events may include performers, traders, activities, scare experiences, talks, panels, entertainment and other features.

Northern Frights Ltd reserves the right to make reasonable changes to an event where necessary.

This may include changes to:

  • Schedules and timings;

  • Activities;

  • Performers or entertainment;

  • Traders;

  • Guests;

  • Stages;

  • Experiences;

  • Event layouts; and

  • Other individual elements of the event.

The advertised line-up and individual event features do not form a guarantee that every advertised element will be available.

A change to an individual activity, performer, guest, trader, schedule or other element does not automatically entitle a ticket holder to a refund where the event itself continues to take place.


12. Event Cancellation

If Northern Frights Ltd cancels an event, ticket holders will be entitled to the refund or other remedies applicable to their booking and required by law.

Where appropriate, we may offer the option of transferring tickets to a rescheduled date or another event.

Any refund will normally be made to the original payment method.

We are not responsible for separate costs incurred by attendees in connection with attending an event, such as travel, accommodation, parking or other expenses, except where liability cannot legally be excluded.


13. Event Add-Ons & Upgrades

The Northern Frights Shop may sell event add-ons including:

  • Fast passes or queue upgrades;

  • Photo opportunities;

  • Scare experiences;

  • Merchandise;

  • Reserved experiences;

  • Activity bookings; and

  • Other event upgrades.

Unless expressly stated otherwise, purchasing an event add-on does not include general admission to the event.

You are responsible for ensuring you hold a valid admission ticket where one is required.

Add-ons may have allocated times, capacity restrictions or other specific conditions.

Where an add-on requires attendance at a particular time, customers are responsible for arriving at the stated location in sufficient time.


14. Event Conduct

All attendees are expected to behave respectfully towards staff, contractors, performers, traders, volunteers and other attendees.

We reserve the right to refuse entry or remove anyone from an event where we reasonably believe their behaviour is abusive, threatening, dangerous, discriminatory, excessively disruptive or otherwise creates a risk to the event or others.

Removal for misconduct will not normally entitle the attendee to a refund.

Illegal substances and items deemed dangerous or prohibited by Northern Frights, the venue or applicable law must not be brought into the event.

Bag or security checks may be conducted where appropriate.


15. Photography & Filming at Events

Personal photography and video may be permitted subject to the rules of the individual event and venue.

Professional or commercial photography, filming or recording may require prior written approval from Northern Frights Ltd.

Northern Frights events may be photographed or filmed by our authorised photographers, videographers, media partners or press.

Images and footage may be used for legitimate promotional and editorial purposes, including websites, social media, advertising, press coverage and future event promotion.

Where appropriate, we will provide information at the event regarding photography or filming. Anyone with particular concerns should speak to a member of staff.


Sponsorship & Advertising

16. Sponsorship & Advertising Purchases

The Northern Frights Shop may allow businesses and organisations to purchase sponsorship, advertising and promotional opportunities.

Unless expressly stated otherwise, these packages are sold on a business-to-business (B2B) basis.

By purchasing a business sponsorship or advertising package, you confirm that you are purchasing it wholly or mainly for purposes relating to your trade, business, craft or profession.


17. Sponsorship & Advertising – Non-Refundable Bookings

All sponsorship, advertising and promotional bookings are non-refundable once purchased, except where Northern Frights Ltd cancels the relevant event or materially fails to deliver the agreed sponsorship or advertising package.

A sponsor or advertiser will not normally be entitled to a refund because they:

  • Change their mind;

  • Decide not to participate;

  • Are unable to attend;

  • Experience a change in their business or financial circumstances;

  • Fail to use an included benefit;

  • Fail to supply required materials by the deadline;

  • Decide the package is no longer suitable; or

  • Do not achieve the commercial results they expected.

Cancellation by the sponsor does not create an entitlement to a refund, credit or transfer.

Northern Frights Ltd may, entirely at its discretion, agree to a transfer, credit or alternative arrangement. Any such arrangement must be confirmed in writing.


18. Event Cancellation – Sponsors

If Northern Frights Ltd cancels an event to which a sponsorship or advertising package specifically relates and the purchased benefits cannot reasonably be delivered, the sponsor will be entitled to a refund of the amount paid for the affected sponsorship or advertising package.

Where appropriate, we may offer the option of transferring the sponsorship to a rescheduled or future Northern Frights event.


19. Failure to Deliver a Sponsorship Agreement

Northern Frights Ltd will make reasonable efforts to provide the sponsorship, advertising and promotional benefits described in the package purchased or otherwise agreed in writing.

If Northern Frights Ltd materially fails to deliver the agreed sponsorship or advertising package, the sponsor should contact us as soon as reasonably possible.

Where we cannot rectify the failure or provide a reasonable equivalent benefit, the sponsor will be entitled to an appropriate refund.

Where substantially the entire agreed package has not been delivered due to a failure by Northern Frights Ltd, this may result in a full refund.

Where only an individual benefit or part of a package has not been delivered, any refund may be limited to a reasonable proportion of the package price reflecting the affected benefit.

For example, failure to provide one individual promotional benefit within a wider package will not automatically entitle the sponsor to a refund of the entire sponsorship fee.

No refund will be due where Northern Frights Ltd was ready and able to provide the benefit but could not do so because of an act or omission by the sponsor.


20. Sponsor Responsibilities & Artwork

Sponsors and advertisers are responsible for providing all required:

  • Logos;

  • Artwork;

  • Advertising copy;

  • Images;

  • Links;

  • Brand information;

  • Approvals; and

  • Other requested materials.

These must be provided by the deadlines and in the formats specified by Northern Frights Ltd.

Failure to provide materials by the required deadline may result in the relevant sponsorship or advertising benefit being reduced or unavailable.

No refund will be due where a benefit cannot be delivered because the sponsor failed to provide the required materials, information or approval by the specified deadline.


21. Approval of Sponsors & Advertising

Northern Frights Ltd reserves the right to ensure that sponsorship and advertising displayed in connection with our events is appropriate for our brand, audience and venue.

We may refuse, remove or require amendments to material that:

  • Is unlawful;

  • Is misleading;

  • Is discriminatory or offensive;

  • Infringes intellectual property or other third-party rights;

  • Is inappropriate for the relevant event or audience; or

  • Could reasonably damage Northern Frights Ltd, the event or another partner.

Where reasonably possible, the sponsor will be given an opportunity to provide alternative material.

Failure by the sponsor to provide acceptable replacement material within the required timeframe does not entitle them to a refund.


22. Changes to Sponsorship Benefits

Northern Frights Ltd may make reasonable operational changes to an event or sponsorship arrangement where necessary.

This may include reasonable changes to the location, timing, positioning, dimensions or method of delivery of an advertising or promotional benefit.

Where a specific benefit cannot be provided, we may offer a reasonably equivalent replacement benefit.

Minor changes or the substitution of a substantially equivalent benefit will not normally constitute a material failure to deliver the sponsorship agreement.


23. No Guarantee of Sponsorship Results

Sponsorship and advertising packages provide promotional opportunities only.

Unless expressly included in the purchased package or agreed in writing, Northern Frights Ltd does not guarantee:

  • A specific attendance figure;

  • A specific number of impressions or views;

  • Social media reach or engagement;

  • Sales;

  • Leads;

  • Enquiries;

  • Conversions;

  • A particular level of footfall;

  • Category or industry exclusivity; or

  • Any particular financial or commercial return.

Failure to achieve the sponsor’s expected commercial results does not constitute a failure by Northern Frights Ltd to deliver the sponsorship agreement.


General Terms

24. Intellectual Property

Northern Frights names, logos, event branding, graphics, photographs, website content and original designs are owned by Northern Frights Ltd or used with appropriate permission.

Purchasing a product does not transfer ownership of any intellectual property associated with its design or artwork.

Northern Frights products, artwork, photographs or designs must not be copied, reproduced or commercially exploited without permission.

Third-party names, characters, brands, artwork and intellectual property remain the property of their respective owners.


25. Discount Codes & Promotions

Discount codes and promotional offers may be subject to additional conditions.

Unless otherwise stated:

  • Discount codes cannot be exchanged for cash;

  • Only one discount code may be used per order;

  • Codes cannot normally be applied retrospectively;

  • Promotions may be changed or withdrawn before an order is placed; and

  • We may refuse or cancel a discount where we reasonably believe it has been used fraudulently or contrary to its stated conditions.


26. Gift Cards

Where gift cards are offered, any expiry dates, restrictions or specific conditions will be stated when they are purchased.

Gift cards cannot normally be exchanged for cash.

Your statutory rights are unaffected.


27. Website Availability & Errors

We make reasonable efforts to ensure information displayed on the Northern Frights Shop is accurate.

However, we cannot guarantee that the website will always be uninterrupted or completely free from errors.

We may correct errors in product descriptions, availability, pricing or other website information when identified.


28. Liability

Nothing in these Terms & Conditions excludes or limits liability where doing so would be unlawful, including liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation.

For consumer purchases, nothing in these terms limits your statutory consumer rights.

Northern Frights Ltd will not be responsible for losses that were not reasonably foreseeable when the contract was formed.

For business-to-business purchases, including sponsorship and advertising, Northern Frights Ltd will not be liable for indirect or consequential losses, loss of profits, loss of business, loss of anticipated savings, loss of revenue or loss of commercial opportunity, except where liability cannot legally be excluded.


29. Personal Property & Event Participation

Attendees are responsible for their own personal belongings.

Northern Frights Ltd is not responsible for loss, theft or damage to personal property except where this results from our negligence or where liability cannot legally be excluded.

Certain event activities may involve scares, darkness, loud noises, flashing effects, physical activity or other immersive elements.

Any relevant restrictions or warnings will be provided where appropriate.

Attendees are responsible for following safety instructions given by Northern Frights staff, contractors, performers and venue staff.


30. Data Protection & Privacy

Northern Frights Ltd processes personal information in accordance with applicable UK data protection legislation, including the UK GDPR and Data Protection Act 2018.

Information provided when placing an order may be used to:

  • Process your payment;

  • Fulfil your order;

  • Administer event bookings;

  • Provide customer service;

  • Communicate essential information relating to your purchase;

  • Prevent fraud; and

  • Meet our legal and regulatory obligations.

Marketing communications will only be sent where we have an appropriate lawful basis to do so.

Where consent is relied upon, you can withdraw that consent or unsubscribe from marketing communications at any time.

31. Complaints

If you experience a problem with a product, order, event ticket, sponsorship package or other purchase, please contact:

Please provide your order number where applicable and sufficient information for us to investigate the issue.

We aim to respond to enquiries and complaints within 14 days.


32. Changes to These Terms

We may update these Terms & Conditions from time to time to reflect changes to our business, products, services or legal requirements.

The terms applicable to a purchase will normally be those in force at the time the order was placed.


33. Severability

If any part of these Terms & Conditions is found to be invalid, unlawful or unenforceable, the remaining provisions will continue to apply.


34. Governing Law

These Terms & Conditions are governed by Scots law.

If you are purchasing as a consumer, you retain any rights provided by applicable consumer law regarding where proceedings may be brought.

For business-to-business purchases, including sponsorship and advertising, the Scottish courts will have jurisdiction over disputes arising from these terms unless otherwise agreed in writing.
